Ruby Capital LLC (“Ruby Capital,” “we,” “us”) operates rubycapitalhomes.com. This policy explains what we collect through this website, why, and what we do with it. It covers this website only.

What we collect

Information you give us through our inquiry form:

  • your name,
  • your email address,
  • your phone number — optional,
  • the property address you are asking about — optional,
  • anything you write in the message field — optional,
  • whether you ticked the optional box giving us permission to text you about your inquiry, including your choice recorded as a yes or a no.

Information our server records when you submit the form:

  • the date and time of your submission, from our server’s clock,
  • the page you submitted from,
  • the exact wording of the consent disclosure that was shown to you,
  • your IP address and browser information.

We record your IP address, browser information, and submission time as a record of your submission and to help prevent spam. We do not use them for advertising or to build a profile of you.

What we do not collect: we do not run advertising trackers, analytics products, session recording, or a chat widget on this site, and we do not ask for Social Security numbers, financial account numbers, or identity documents through this website. Do not send those to us through the form.

Why we use it

  • To read and respond to your inquiry.
  • To contact you about your property using the contact methods you gave us.
  • To keep a durable record of whether you gave, declined, or withdrew permission to receive text messages, and of the exact wording you were shown when you decided.
  • To keep our site working and to reduce spam and abuse.
  • To meet legal, regulatory, and messaging-industry obligations that apply to us.

We do not use your information to make automated decisions about you, and we do not sell it.

Text messages

Text messages are entirely optional. Consent is not required to submit this form, to receive a reply, to get an offer, or to sell your property.

Mobile information and text-message consent are not sold or shared with third parties or affiliates for their own marketing or promotional purposes. No mobile opt-in data is shared with lead generators.

Your phone number and your consent choice are handled by the service providers described below only so that they can operate our website, our email, and — once it exists — our messaging program on our behalf. Those providers act on our instructions and may not use your information for their own marketing.

At the date of this policy we are not sending text messages at all. See our SMS Terms for the program’s status and for how to stop messages at any time.

Who processes your information

We are a small business and we use ordinary third-party services to run this website. Those providers process your information on our behalf, under our instructions, so that we can respond to you — for example a hosting provider serving the website, a service that delivers the form submission to our email, and, in future, a messaging provider.

We are not able to promise that no third party ever handles your data — that would not be true of any modern website. What we do commit to is: we choose providers for the purpose of running this service, we do not authorize them to use your information for their own marketing, and we do not sell or rent your information to anyone.

The specific providers we use for form delivery and messaging have not been selected and configured yet. Before this website begins accepting inquiries we will name, on this page, the provider we use for each of the following:

  • website hosting and delivery,
  • inquiry delivery and email,
  • text messaging — only if and when the SMS program is activated.

Until those names appear here, no provider has been named because none has been chosen. If you want to know who holds your information at any point, ask us and we will tell you.

When we would disclose your information

We disclose your information only:

  • to the service providers described above, so they can perform their function for us;
  • to our professional advisers — for example an attorney, an accountant, or a title or closing company — where that is necessary to evaluate or complete a transaction you have asked us to pursue;
  • where we are required to by law, subpoena, court order, or other legal process, or to establish or defend legal claims;
  • to protect the rights, property, or safety of you, us, or others;
  • with your direction or permission.

If our business is ever sold or reorganized, information could transfer as part of that transaction; any text-message permission would not transfer. A permission you gave to Ruby Capital LLC applies to Ruby Capital LLC. A new owner wanting to text you would have to ask you again.

How we protect it

We use reasonable administrative and technical measures intended to protect the information you send us, including transport encryption for this website and limiting access to the people who need it.

No method of transmitting or storing information is completely secure, and we cannot and do not guarantee the security of your information. Please do not send sensitive personal or financial information through the form.

How long we keep it

We keep inquiry information for as long as we need it to respond to you and to handle the matter you contacted us about, and then for a limited period afterward for our business records.

We keep records of text-message consent — and of any withdrawal of consent — for longer than the inquiry itself, because those records are the proof of what you agreed to and of your decision to stop. We keep records of an opt-out for as long as we would otherwise be capable of contacting you, so that an opt-out is not accidentally undone. We do not delete an opt-out record in order to “clean up” a contact list.

We have not fixed a single retention period for every category of information here, and we are not going to state one we have not actually adopted. We are establishing a written retention schedule and will describe it on this page once it is set. If you want to know what we hold about you, ask us.

Your choices

  • Texts: don’t tick the box, or tick it and reply STOP later. Either is fine and neither affects your inquiry. See SMS Terms.
  • Phone and property address: both are optional on our form.
  • Access, correction, deletion: email us and we will do our best to honor reasonable requests about the information you gave us, subject to records we are required or reasonably need to keep — including opt-out records, which we keep precisely so we do not text you again.

Which privacy laws apply to us

We have looked at this rather than copying boilerplate.

  • California (CCPA/CPRA): the CCPA applies to a business only if it meets one of three thresholds — annual gross revenue above roughly $26.6 million, buying/selling/sharing the personal information of 100,000 or more California consumers or households in a year, or deriving 50% or more of revenue from selling or sharing personal information. Ruby Capital LLC does not meet any of them: we are a small Indianapolis-focused business, we do not operate at that scale, and we do not sell or share personal information at all. The CCPA does not currently apply to us.
  • Indiana (Indiana Consumer Data Protection Act, effective January 1, 2026): it applies to businesses that in a calendar year control or process the personal data of at least 100,000 Indiana residents, or of at least 25,000 Indiana residents while deriving more than half of gross revenue from selling personal data. Neither applies to us, so the ICDPA does not currently apply to us.
  • EU/UK (GDPR): we do not have an establishment in the EU or UK, we serve homeowners in and around Indianapolis, Indiana, and we do not target or offer services to people in the EU or UK. The GDPR does not currently apply to us.
  • What does apply to us regardless of size: federal and Indiana telephone and text-message rules — the Telephone Consumer Protection Act and the FCC’s rules, Indiana’s telephone solicitation law (IC 24-4.7), and Indiana’s telephone privacy law (IC 24-5-14) — along with general consumer protection law prohibiting deceptive practices, and the messaging policies of our provider and the mobile carriers.

If our size or practices change so that one of these privacy laws does apply, we will update this policy and honor the rights it gives you. Separately, we will make a good-faith effort to honor reasonable access, correction, and deletion requests even where a statute does not require it.

Children

This website is not directed to children and we do not knowingly collect information from anyone under 13. If you believe a child has sent us information, contact us and we will delete it.

Links to other websites

If we link to another website, that site’s own privacy practices apply once you leave ours.

Changes to this policy

We will post changes here and update the “Last updated” date. If we change how we handle text-message consent, we will not apply the change retroactively to permissions people already gave.
